Charge violating builders, DTCP told

GURGAON: Punjab and Haryana high court has ordered the DTCP to register criminal cases against the builders who have committed gross, non-compoundable violation of the structure designing or zoning plan and sold plots to various people without getting the occupation certificate.

The court had passed these directives on February 19 while hearing the petition moved by the Ardee City Residents' and Flat Buyers' Association which had challenged the DTCP notice against the house owners who were living in the houses and floors without securing an occupation certificate in 2010.

On account of structural violations, the DTCP had rejected the applications for issuance of occupation certificate, the petitioners had moved to the court. The court was informed that the builders had constructed the houses in violation of the sanctioned building plan and sold them.

Last year the court had to conduct a survey to ascertain the quantum of violations of the building bylaws and to devise a scheme with which the violations could be regularized/ compounded and action taken against the erring builders, who have committed non-compoundable violations.

The Senior Town Planner (STP), Gurgaon, came out with a detailed measurement of these premises to find out the quantum and nature of violations and as to whether these violations are compoundable or non-compoundable under the existing policy. The survey revealed that out of 372 plots, 204 are fit for grant of occupation certificate because the violations committed on these plots are compoundable. In the remaining 168 plots, violations of building bylaws are non-compoundable and need to be rectified.

To get the possibility of rectification examined, the STP, Gurgaon, has sought a report from Pradeep Kumar Kulshreshtha, Structural Engineer, Engineering Associate-Consulting Engineer based in Delhi, who has stated that, based on preliminary observations, they are of the opinion that some of the violations are rectifiable without any damage to the safety of structure with proper engineering intervention and structural retro-fitting as explained in the letter.

After the hearing the court also directed builders and licensees, to move an application within one month under rules for obtaining occupation certificates from the DTCP, irrespective of whether they have earlier filed applications which may be pending or rejected. The court also ordered the STP, Gurgaon, to consider these applications with a positive attitude to resolve these problems of the thousands of allottees in the light of latest policy decisions taken by the government.

On the question of violations committed by the builders, the court held the DTCP will get them cleared from them after charging the compoundable fee or, if non-compoundable, direct them to remove those violations and in case there is violation in the structure designing, the builders can be imposed penalty after getting the revised plan, in preference to demolition. In case the builders or licensees have committed gross, non-compoundable violation of the structure designing/zoning plan and sold plots then it will be open for the DTCP to blacklist them for the future and to register criminal cases against them.





Residents hail court order

GURGAON: The Punjab and Haryana high court order on the petition by residents of Ardee City has evoked mixed reaction as the builders to remove the structural violations and pay penalty within the next six months.

The residents, especially those whose houses had been in the list in which the structural violations are over 10%. The DTCP had earlier made 10% violations in houses compoundable which means the owner or the builder can pay penalty and get the occupation certificates. The court has clearly stated that in houses where the violations are beyond 10%, the builder will have to pay penalty.

A house owner, Shushil Khanna, said: "The court has rightly made builders accountable for the violations and now he has to pay penalty and applicable compounding charges, not the house owners." Explaining the procedures now after the court order, he said: "The compounding charges up to 10% in each house will be calculated as per the slab of the DTCP and beyond that the penalty has to be paid by the builder."

The upscale township has over 1,500 houses which have minor and major structural violations. The court has also clarified that in the houses where violations are more than 10%, the builder first has to make structural changes, and if it is unfeasible than penalty has to be paid.

The president of Ardee City RWA, T N Kaul, expressed his apprehension over the structural damages in the houses with major violations. "In the event of major violation, a portion is to be removed in a ground floor, then the two upper floors may get structural damage threat too. The rectification order has scared all 1,500 families of course," said Kaul.

For the removal of the structural violations the court has directed the DTCP to remove only those portions that do not cause serious damage to the entire three-storey building structure. The court order has been hailed as historic by several activists in the city. "It will have a great impact on such colonies where structural violations have been done by the developers," said Dharambir Yadav, president of Mayfield Gardens RWA.

बिल्डिंग प्लान का हुआ उल्लंघन

गुड़गांव।। आरडी सिटी रेजिडेंट एंड फ्लैट बायर असोसिएशन की याचिका पर पंजाब एवं हरियाणा हाई कोर्ट ने बिल्डर के खिलाफ कड़ा रुख अख्तियार किया। हाई कोर्ट की डबल बेंच ने कहा कि टाउन एंड कंट्री प्लानिंग ( टीसीपी) डिपार्टमेंट की तरफ से प्रस्तुत कागजात के अनुसार बिल्डर ने बिल्डिंग प्लान का उल्लंघन किया है। इसका खामियाजा 372 मकानों में रहने वालों को उठाना पड़ा। बिल्डिंग प्लान उल्लंघन को दुरुस्त कराने का आदेश भी दिया गया है। अगर बिल्डर यह नहीं कराता है तो उस पर एफआईआर दर्ज कराई जाए। प्रभावित लोगों को कंप्लीशन सर्टिफिकेट दिया जाए। पूरी प्रक्रिया 6 महीने के अंदर पूरी की जाए।

11 मई, 2010 को टीसीपी डिपार्टमेंट ने 1295 मकानों को अखबारों के माध्यम से सार्वजनिक किया था। इनमें रहने वालों को आदेश जारी किए गए थे कि उन्होंने बिना परमीशन के गृह प्रवेश किया है। इसके चलते वह मकान को खाली करें। यदि ऐसा नहीं किया गया तो इसे खाली कराकर उसे सील कर दिया जाएगा। इन मकानों में आरडी सिटी कॉलोनी के 372 मकान भी शामिल थे। इसके विरोध में आरडी सिटी रेजिडेंट एंड फ्लैट बायर असोसिएशन ने पंजाब एवं हरियाणा हाई कोर्ट की शरण ली। आरडी सिटी के अलावा सुशांत लोक वन, टू व थ्री, मालिबू टाउन, मेफिल्ड गार्डन, डीएलएफ आदि के मकान भी शामिल हैं।

हाई कोर्ट के जज जस्टिस सतीश कुमार मित्तल व जस्टिस अमोल रतन सिंह की डबल बेंच ने याचिका पर 24 दिसंबर को पहले आदेश जारी किए थे। इसमें टीसीपी अधिकारियों को कहा गया था कि कॉलोनी का सर्वे किया जाए। इसमें बताया जाए कि कितने मकानों को अब तक कंप्लीशन सर्टिफिकेट नहीं दिया गया है। 11 फरवरी , 2012 को हाई कोर्ट में प्रस्तुत रिपोर्ट में बताया गया कि 372 मकानों को सर्टिफिकेट जारी नहीं किया गया है। बिल्डर ने बिल्डिंग प्लान का उल्लंघन किया है। इस एरिया में 204 फ्लैट बनाने थे , लेकिन 168 फ्लैट अधिक बनाए गए।

इस रिपोर्ट के आधार पर डबल बेंच ने कहा कि जिन मकान मालिकों ने कंप्लीशन सर्टिफिकेट के आवेदन को टीसीपी अधिकारियों ने रिजेक्ट कर दिया है, वह एक माह के अंदर फे्रश आवेदन करें। अधिकारियों को आदेश दिया गया कि कंप्लीशन सर्टिफिकेट जारी किया जाए। यदि किसी अलॉटी ने स्वयं अपने मकान में निर्माण नियम का उल्लंघन किया है तो उसे नोटिस कर अवैध निर्माण को हटवाया जाए। उसके बाद सर्टिफिकेट जारी किया जाए। बिल्डिंग की मान्य उल्लंघन को जुर्माने के बाद मंजूर किया जाए, जो उल्लंघन मान्य नहीं है, उसे दुरुस्त करवाया जाए। यदि इन उल्लंघन को लेकर बिल्डर की तरफ से जुर्माना राशि जमा नहीं करवाई जाती है तो उसकी प्रॉपर्टी से इस राशि को वसूल किया जाए। साथ ही उसके खिलाफ क्रिमिनल एक्ट के तहत मामला दर्ज करवाया जाए। पूरी कार्रवाई 6 महीने के अंदर पूरा करने का आदेश दिया गया है। इस मामले में बिल्डर का पक्ष जानने की कोशिश की गई, लेकिन कोई संपर्क नहीं हो सका।

Hon'ble Punjab and Haryana High Court has given a historic decision which shall set example to Builders/ Colonizers/Developers to think twice before commiting violations in future.
2.In the year 2006 ,the Builder had usurped greenery in a plot of about 60x45 Meters in B-Block forcing the residents to file petition for permanent injunction.The trial court as well as court of the Addl. District Judge(first appellate authority) had dismissed the petition for interim injunction but the hon'ble high court ruled in favour of the residents.Not only that the hon'ble high court has directed the trial court to decide the suit by 31 st March ,2013 ,which is pending for full 7 years.
3.It has also come to notice that the Builder is adopting coercive methods to force the petitioners to withdraw from the above suit by declining to get "conveyance deed" of their flats executed until they withdraw their names by giving statement in the trial court. May I request the RWA to look into this matter ?

Good Efforts from RWA. can we get list of all flats 204 that are fit for grant of occupation certificate because the violations committed on these plots are compoundable and also list of remaining 168 plots, violations of building bylaws are non-compoundable and need to be rectified.
Also, what would be the way forward to close this & get OC

Is it possible to get these lists of houses on 168 plots where the construction needs to be rectified...other 204 will then assume that they are safe...
