As the residents are aware, S/Shri Arvind Kumar and Arun Sharma have, along with Shri Sharad Sharma, Advocate, attended two hearings held on August 28 and September 30, 2014, in the court of the District Consumer Forum. Besides, Mrs. Shubra Bansal, Collegium member and Shri S.K. Jindal have attended a meeting in the office of the Senior Town Planner, on the 30th September, 2014.
The outcome of the above meetings is that the Builder has been directed to hand over the Occupation and completion certificates to the RWA; the electricity bill be accepted without insisting on the maintenance bill and finally the RWA IS FREE TO REVOKE THE SUPPLEMENTARY AGREEMENT AFTER A MEETING WITH THE BUILDDER. The builder has not responded to our letter dated 1.9.2014 for the meeting proposed for revoking the supplementary agreement in terms of the Court's directions, with the result that the terms of the Supplementary Agreement, including the rate of Rs.1686/-are no longer binding on the residents, i.e. they are now free to go back to the rate of about Rs.375/- per monthly maintenance bill with immediate effect.
As an alternative to the attitude of the builder in not coming forward for the meeting or in case they do not accept Rs.375/- p.m. the RWA have, for facility of the residents, since opened a ARDEE CITY RWA MAINTENANCE ESCROW ACCOUNT (No.CBCA/Ol/7326), to which the payment cheques can be deposited through RWA. The next date of hearing in the matter is Feb.15, 2015.
IT MAY BE ADDED THAT THE OFFICIAL COPY OF THE SAID COURT ORDERS IS STILL AWAITED. If their perusal reveals any change, the residents will be suitably informed.
The residents, especially the Collegium members are requested to pay the cheques IN THIS ESCROW ACCOUNT only so that a clear message can reach the residents for the course of action
Unless the Collegium leads by setting personal example, it will be difficult to ask the residents for the same.
The meeting with the Senior Town Planner has also been very useful. The STP has made it clear that if the builders fail to comply with the order of the Hon. High Court within maximum of 30 days w.e.f. 1.10.2014, he will be forced to lodge an FIR against them for non-compliance of the said order.. It is therefore in our interest also, if our Ccs are pending, to complete the necessary formalities under intimation to the STP as early as possible. He assured that he would not mind issuing the CC to individual flat owner if the latter has fulfilled his part, though the best option would be to issue the same for all the 3 floors simultaneously.
It is proposed to introduce 'Associate Membership' category on payment of Rs.100/- p.a., but such members will not enjoy voting rights.
The residents might be aware that the RWA is going to celebrate the Dussehra festival on the 3rd October 2014, on the plot of land near Gate No.1. From 2.00 p.m. Onwards. All are cordially invited. The RWA conveys its best wishes on the occasion.

PS: The Governing body would be convening an emergency meeting in the next 2-3 days for affirming the position regarding the rate of maintenance charges and associate membership before they are actually acted upon.
