RWA Update on Actions 25-Nov-2014

• On the 22nd November, the resident of C-95, Ardee City brought to the notice of the President RWA that his water supply connection had been disconnected. Thereafter, about 30-40 residents met at the Ardee City Site office to bring this serious matter to the notice of the Management for immediate remedial action. The police was also called. After a lot of heated discussion and arguments, a complaint was registerd by S/Shri Arvind Kumar, Sharad Sharma and the allottee (Shri Madan). The water supply connection was soon got restored at personal level.

• Governing Body took a very serious note of this incident. They decided that henceforth, in the interest of the residents, the RWA would be receiving the electricity bills as well as the maintenance bills to facilitate the payment of electricity cheques to Ardee Management. The maintenance bills will be acknowledged as “Received for Escrow Account”. The acknowledgement portion of the electricity bills would be returned to the residents concerned after it is paid to the Ardee Office. For this it would be essential that the residents should deposit the bills at least 2 working days before the due date of payment at the RWA office between 11.00 a.m. To 4.00 p.m (except Wednesdays). The idea of a drop box was not appreciated. This facility is being provided to mitigate the hardship of the residents and would be available to those paying both electricity and maintenance (to RWA escrow a/c) at RWA office.

• The Governing Body gave a green signal to appoint Shri Yogender Mohan Ambardar as the Election Officer and to go ahead with the election process without any further delay. Letter of appointment of Shri Ambardar  is under issue.

• Regarding the 'Open House' meeting on the 30th November, a formal request has been delivered at the Site Office for necessary permission to use the ground near gate No.1, for the purpose. Shri Vikas Sanjit will look after the logistics and the arrangements for the same.  The tentative agenda for the meeting would consist of: (I) the reply proposed to be filed in the State level  Forum on the stay obtained by the Opposite party on the issue of revocation of the supplementary agreement dt.16.8.2013; (ii) hardship being faced by the residents who have deposited cheques for maintenance charges in the Escrow Account at the suggestion of RWA. It is hoped that collection of both the electricity as well as the maintenance cheques at  RWA, as explained above, would be a good step in this direction, as would be the action taken on disconnection of water supply. Further steps, as and when warranted, would also be taken likewise.   Besides, the RWA is going to file on 25.11.2014, an Urgent Petition before the District Forum, containing all facts and previous incidents on the part of the Builder, which were in violation of the various orders/judgments, seeking a direction that the builder accepts the electricity bills without insisting on simultaneous payment of the maintenance bills, especially in view of unclear fate of the supplementary agreement dated 16.8.2013, and the Forum's order dt. 12.5.2013, to the effect that electricity/water cannot be disconnected when security is available.  This application will, more or less form the basis of our reply before the State level commission, where the next date of hearing is 16.1.2015, followed by a date in the State forum on 25.2.2015.

• It is repeated once again that Governing Body needs to be reassured that the Residents are with them and at their back 100%, so that they can face the Management without a blink. The open meeting proposed for the 30th November, 2014, will surely serve as an eye-opener on the subject.
