RWA Update on Actions 8-Aug-2014

Communiqué dated 8.8.2014.

• A very piquant situation has been created by the Ardee Management by refusing to receive payment of electricity bill unless the maintenance bill is also paid along with it.  The President, the General Secretary and the Treasurer along with Shri Vineet Kumar Maheshwari and Dr. Hadda residents, met the Vice President and the General Manager, Ardee Management on the 7th instant to sort out this matter. The Ardee Management sounded down-right offensive by saying: We are doing what we have to do and you may do what you like to do”. Efforts to moderate this attitude and to bring some element of conciliatory attitude did not succeed.
• In another incident, Dr. Hadda, a resident wanted to seek clarification regarding replacement of defective cables. The General Manager stated that the cost of the cable as well as the cost of labour would have to be borne by the allottee. The Ardee Management responsibility is for the stretch from the junction box to the meter box, and that too, for the first time when they sell/hand-over the flat to the buyer.  Anything beyond and thereafter is the responsibility of the allottee. When it was pointed out that  as per the law, it is a criminal offence to even touch the electrical wires between  the junction box and the meter box and that the meter box is (at least supposed to be) sealed, which cannot be tempered with, no satisfactory answer was forthcoming. In the light of this situation, the General Manager was requested to please have it prominently displayed at the Complaint/Site office to indicate (i) the responsibilities of the Management; and (ii) responsibilities of the allottee., so that there is no confusion.  The Management may do the needful since it does not involve any expenditure, but the body language did not give any such indication.
• It may be added that last time when RWA wanted to take a united action regarding payment of electricity/maintenance bills, there were divided voices and only 286 residents complied with the procedure and this number came down to 160 at the time of the subsequent bill. It became a joke in the eyes of the Management. Again, since the payment was delayed because the Management refused to accept single bills, a nominal late fee of Rs.26/- per bill was levied. This was very much resented by some residents. 
• On 7.8.2014, the General Secretary of RWA and Shri Vikramjit Singh went to lodge an FIR at the Police station on the ground that the Management was not accepting the payment of the electricity bill raised by them. They could not succeed on that date. This has happened today with the efforts of Shri Singh and Shri Vineet Maheshwari. It is understood that quite a few residents have paid the bills. It may be noted for information that the RWA’case  before the Consumer Court is fixed for hearing on the 29th instant. The stand to be taken has been communicated in the previous communications, but it would need to be firmed up with a legal opinion. 
• Today, the General Secretary, RWA and shri Arun Kumar Sharma met the Senior Town Planner. We brought to his notice the following:
  • The minutes of the meeting with D.C. Gurgaon held on 23rd July 2014 omitted the name of the Ardee City RWA, though they attended the meeting, with the result that they did not officially receive a copy of the minutes.  Necessary instructions were given to do the needful.
  • That there is a lot of illegal construction of shops, etc. as well as encroachments, which is endangering the social and security fabric in the colony and converting it into a slum with garbage full of stink all around.  The STP gave instructions for writing to DTP(Enf) Gurgaon and to Ardee Management for taking action.
  • The STP was requested to supply the RWA a list of O.Cs issued  and a list of O.Cs not issued along with reasons for the same. This would be made available to RWA in 2-3 days time.
