Regarding occupation certificates of floors and notice sent by STP, Gurgaon dated 11/05/2010 and 12/05/2010 in HT and TOI
Dear Residents,
This association in general has sent a protest representation dated 22/05/2010 to the STP concerned. Further to that we have discussed this matter with STP on 25/05/2010 along with other representatives of different societies.
The association pointed out that, for all builder floors only builder is responsible for obtaining occupation certificate for concerned authorities. These builders built the floors and sold them to individuals on the assurance that the process of obtaining occupation certificates was in process hence the floor buyers can occupy these floors on the basis of provisional possession certificates issued by them.
- When the occupation certificates did not come, the association sent in notices to the builders.
- The residents has now come to know that builder and STP never informed them officially about problems going on for getting these certificates.
- Its prime responsibility of builder to obtain completion & occupation certificates hence the liability is on the part of the builder.
The builder has obtained the license from your department, the builder for the negligence on his part must be brought to case, but the sealing, demolition and punishment notices were sent to innocent flat buyers.
We have issued notices to the builders again so that they may act in time.
On these grounds we have been assured from STP to get favorable response in time and same would be conveyed to the residents as soon as we receive.
